General Privacy Statement

 

BAFT Law Office (“We”) is a full-service law firm, duly organized under the laws of the Republic of the Philippines, and with principal office address at Door 8, 2nd Floor, TAA Center, F. Cabahug St., Kasambagan, Cebu City, Philippines.

 

We respect your privacy and take proper measures to manage and protect your personal data. By accessing our website, we assure you of our full compliance with the appropriate standards under Republic Act No. 10173, otherwise known as the “Data Privacy Act”.

 

Service Description

 

Our practice includes the entire spectrum of Philippine law. We provide legal advice and representation on a wide range of matters including but not limited to laws and transactions relating to business, employment, family, immigration, intellectual property, litigation, and real estate, among others. 

 

Information We Collect

 

We collect the following information (collectively, “Information”):

 

  1. Personal Information and Sensitive Personal Information or any information that identifies you as an individual, such as but not limited to your name, age, date of birth, gender, civil status, nationality, address, email address, and phone number, among others.

  2. Non-personal Information or any information stored by and provided by your device, such as but not limited to your IP address, geolocation, operating system, browser type and version, and other machine identifiers, among others; and 

  3. Any other information which are not covered by the foregoing but which you otherwise disclosed to us to avail of and for us to provide legal services. 

 

Collection Method

 

We collect your Information, directly or indirectly, through any of the following means:

 

  1. When you fill out forms on our website; or

  2. When you communicate with us in person, or through emails, phone calls, text messages, or via any of our social media accounts, whether in writing, verbally, or through electronic means; or

  3. When you submit documents, correspondences, or any other items which reveal your Information; or

  4. When obtained from third parties or other sources which have obtained your prior consent for disclosure, or when we are legally allowed to acquire any such Information.

 

Use and Purpose

 

We collect your Information to assist you in your legal concerns, to perform our obligations as lawyers (e.g., provide legal advice, render legal opinion, provide legal representation, etc.), and to comply with legal and regulatory requirements. 

 

Storage and Transmission

 

We maintain and implement organizations, physical, and electronic security measures to ensure confidentiality of your Information such as:

 

  1. We process your Information only as may be necessary to render and complete our legal services;

  2. For physical records reflecting your Information, we keep them in a secure facility within our office;

  3. For electronic data reflecting your Information, we employ electronic security controls such as firewall, encryption, and anti-virus;

  4. We restrict access to your Information to lawyers and authorized personnel as may be necessary; 

  5. We may engage the services of third parties and may disclose your Information on a need-to-know basis to render and complete our legal services; and

  6. We regularly conduct internal orientation to manage and protect your Information.

 

Retention Period

 

We keep and retain your Information until the completion of any given referral and the fulfillment of the specific purpose for which your Information was obtained and ten (10) years thereafter. After which, we will redact all Information, whether physical or electronically, but will keep forms and templates as may be necessary. 

 

Rights of the Data Subject

 

In accordance with the Data Privacy Law, we shall respect and uphold your rights as data subjects. For more information about your rights, kindly refer to National Privacy Commission’s webpage at https://privacy.gov.ph/know-your-rights/.  

 

Review

 

We will review this policy every two (2) years and may amend the same at any time if deemed necessary.

 

Effectivity

 

This Policy shall take effect on 8 July 2022.
